Terms and Conditions of Service

IMPORTANT NOTICE — PLEASE READ CAREFULLY

By accessing, purchasing, or using any service from GCC Media Group, completing a payment, or submitting content, you confirm that you have read, understood, and agree to be legally bound by this Agreement in its entirety. If you do not agree, you must not proceed.

1. Parties and Scope of Agreement

These terms and conditions ("Agreement") constitute a legally binding contract between GCC Media Group ("Company," "we," "us," or "our") and the individual or entity purchasing or using our services ("Client," "you," or "your").

GCC Media Group is a public relations and media placement agency operating through gccmediagroup.com. We provide editorial content development, media pitching, press article publication, and reputation management services. The Company acts primarily as an intermediary facilitating content placement across a network of independent third-party media outlets.

2. Description of Services

2.1 Core Services Provided

GCC Media Group provides the following services:

  • Drafting, editing, and placing press articles, editorial features, and profiles about the Client across third-party media outlets within our network;
  • Pitching Client stories, announcements, and news to journalists and publishing partners;
  • Press release writing, distribution, and syndication;
  • Advertorial and sponsored content placement;
  • Brand narrative development and public relations strategy consulting;
  • Online reputation management and digital presence enhancement.

2.2 Nature and Limitations of Media Placements

The Client acknowledges and accepts the following:

  • Placements are subject to the editorial discretion of third-party publications. GCC Media Group guarantees publication in at least one outlet within our network but cannot guarantee placement on any specific outlet unless confirmed in a separate written agreement.
  • Any reference to specific example outlets in marketing materials is illustrative only and does not constitute a guarantee of placement on those outlets.
  • The tone, formatting, and final presentation of content may be modified by the publishing outlet's editorial team without Client's prior approval.
  • GCC Media Group guarantees pitching within seven (7) days of final content approval. The first publication generally occurs within thirty (30) days, but it remains subject to third-party editorial scheduling.
  • Permanent online availability of published articles cannot be guaranteed. Third-party outlets may update, archive, or remove (together, "Removal") content at their sole discretion after publication. Such Removal shall not constitute grounds for refund, dispute, or chargeback.

3. Client Representations and Warranties

3.1 Accuracy and Lawfulness of Submitted Content

By submitting any content, information, or materials to GCC Media Group, the Client expressly represents, warrants, and covenants that:

  • All information, statements, facts, credentials, biographical details, and claims submitted are truthful, accurate, complete, and not misleading in any material respect;
  • The Client owns or has full, valid, and legally enforceable authorization to use all submitted materials, including images, trademarks, quotes, and third-party content;
  • The content does not infringe any intellectual property rights, privacy rights, publicity rights, or other rights of any third party;
  • The content does not contain defamatory, libelous, fraudulent, misleading, harassing, abusive, or unlawful material as defined under applicable law;
  • The content does not promote any illegal activity, including but not limited to fraud, or financial crime.

The Client acknowledges that these representations form a material inducement for GCC Media Group to provide services, and that any breach of these warranties constitutes a material breach of this Agreement.

4. Content Review and Editorial Discretion

GCC Media Group reserves the sole and absolute right to:

  • Reject, decline, or refuse any submission that contains or promotes abuse, fraud, crime, harassment, deception, or illegal activity as defined under applicable law, or any material deemed harmful, inappropriate, or reputationally damaging;
  • Edit, modify, restructure, or rewrite submitted content to meet publication standards, factual accuracy requirements, or legal compliance obligations;
  • Remove or request retraction of content where we become aware of inaccuracies, legal risks, or policy violations after publication.

If a submission is rejected on grounds of policy violation, no refund shall be issued and GCC Media Group reserves the right to terminate services immediately.

5. Payment, Refunds, and Chargebacks

5.1 Non-Refundable Payments

All payments made to GCC Media Group are final and non-refundable upon processing. The Client expressly waives any right to request a refund under any circumstance, including but not limited to:

  • Dissatisfaction with the specific media outlet selected for placement;
  • Publication timing or scheduling delays caused by third-party outlets;
  • Editorial adjustments made by the publishing outlet;
  • Failure to achieve specific business, SEO, or reputational outcomes;
  • Change of mind or cancellation of services after payment;
  • Subscription cancellation or service termination for any reason.

5.2 Chargebacks and Payment Disputes

Initiating an unjustified chargeback, fraudulent payment dispute, or reversal request constitutes a material breach of this Agreement. In such cases, GCC Media Group reserves the right to:

  • Submit all documentary evidence to the relevant financial institution to contest the dispute;
  • Immediately suspend or terminate all services and remove published articles without notice;
  • Pursue recovery of outstanding amounts through debt collection agencies;
  • Initiate legal proceedings to recover the disputed amount, plus all associated legal, administrative, and recovery costs.

The Client agrees to bear all costs, legal fees, and damages arising from any wrongful payment dispute initiated against GCC Media Group.

6. Subscription Terms and Article Availability

Where services are provided on a subscription basis:

  • Continued online availability of published articles is conditional upon the Client maintaining an active, paid subscription in good standing.
  • In the event of subscription cancellation, non-payment, suspension, or termination for any reason, GCC Media Group reserves the absolute right to request retraction, removal, or de-indexing of all articles published under that subscription.
  • The Client shall not be entitled to any refund, compensation, or damages arising from the removal of articles following subscription termination.

7. Limitation of Liability

7.1 Excluded Liabilities

To the fullest extent permitted by applicable law, GCC Media Group shall not be liable to the Client or any third party for:

  • Editorial decisions, modifications, or rejections made by third-party media outlets;
  • The final published version, presentation, or formatting of any article;
  • Business outcomes, reputational results, SEO performance, website traffic, revenue, or any financial impact arising from media placements;
  • Permanent availability, archiving, or removal of articles by third-party outlets.

8. Client Indemnification and Liability for Third-Party Claims

8.1 General Indemnification

The Client agrees to fully indemnify, defend, and hold harmless GCC Media Group, its directors, officers, employees, contractors, agents, affiliates, and media partners (collectively, the "Indemnified Parties") from and against any and all claims, actions, proceedings, demands, liabilities, losses, damages, judgments, fines, penalties, settlements, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Any content, materials, or information submitted by the Client to GCC Media Group;
  • Any misrepresentation, inaccuracy, or false statement contained in submitted content;
  • Any infringement of intellectual property, privacy, publicity, or other rights caused by the Client's submitted content;
  • Any breach by the Client of this Agreement or any applicable law;
  • Any legal claim, regulatory action, or third-party complaint arising from or related to published material submitted by the Client.

8.2 GCC Media Group's Right to Claim Damages from Client

CLIENT LIABILITY WHERE GCC MEDIA GROUP IS SUED OR THREATENED WITH LEGAL ACTION

If GCC Media Group becomes the subject of any legal action, claim, investigation, regulatory proceeding, demand letter, injunction, or lawsuit brought by any third party — including but not limited to defamation claims, intellectual property infringement claims, privacy violation claims, fraud allegations, or claims brought by media outlets, journalists, or members of the public — arising directly or indirectly from content submitted by the Client, the Client shall be solely and fully liable for all resulting consequences.

GCC Media Group shall be expressly entitled to pursue the Client for full recovery of all losses, damages, and costs incurred, including without limitation:

  • All legal and solicitor fees, court filing costs, arbitration fees, expert witness fees, and disbursements incurred in defending, responding to, or resolving such claims;
  • Any damages, compensation, fines, or settlement amounts awarded against or agreed to by GCC Media Group as a result of the claim;
  • Direct and indirect operational losses suffered by GCC Media Group arising from the legal action, including loss of business and reputational harm;
  • Costs associated with article removal, retraction notices, correction notices, takedown requests, or any compliance obligations triggered by the claim;
  • Any regulatory fines, penalties, or sanctions imposed as a result of content submitted by the Client;
  • Administrative costs, investigative costs, and PR or reputation recovery expenses incurred by GCC Media Group as a result of the claim.

GCC Media Group reserves the right to immediately suspend or terminate all services upon receipt of any legal threat, claim, or notice of proceedings related to Client-submitted content, without any obligation to issue a refund.

The Client's liability and indemnification obligations under this Section 8 shall survive the termination or expiry of this Agreement and shall remain fully enforceable regardless of the date on which a legal claim arises, provided it relates to content submitted during the term of the Agreement.

9. Prohibited Conduct and Zero-Tolerance Policy

GCC Media Group operates a strict zero-tolerance policy towards the following conduct by Clients or their representatives:

  • Abusive, threatening, harassing, defamatory, or disrespectful communication directed at Company staff, contractors, or media partners;
  • Submission of fraudulent, misleading, fabricated, or unlawful content for publication;
  • Attempting to manipulate, deceive, or coerce media outlets or journalists through the Company's services;
  • Initiating fraudulent chargebacks, payment reversals, or bad-faith payment disputes.

Any violation of this policy entitles GCC Media Group to immediately terminate all services without refund and to pursue all available legal remedies, including claims for damages arising from such conduct.

10. Intellectual Property

The Client grants GCC Media Group a non-exclusive, royalty-free license to use, reproduce, edit, and distribute submitted content for the sole purpose of providing the agreed services. All intellectual property rights in the Client's original submitted materials remain the property of the Client, subject to the warranties given in Section 3.

All proprietary materials, methodologies, templates, processes, and systems developed by GCC Media Group remain the exclusive intellectual property of the Company and may not be reproduced, reverse-engineered, or distributed without prior written consent.

11. Confidentiality

Both parties agree to keep confidential all non-public information disclosed during the course of the business relationship. GCC Media Group will not disclose Client information to third parties except as necessary to perform the agreed services, as required by law, or with the Client's prior written consent. This obligation shall survive termination of this Agreement for a period of five (5) years.

12. Termination

GCC Media Group reserves the right to terminate this Agreement and all associated services immediately and without prior notice in the event of:

  • Material breach of any provision of this Agreement by the Client;
  • Submission of content found to be fraudulent, defamatory, or unlawful;
  • Threatening, abusive, or harassing conduct by the Client;
  • Non-payment, subscription lapse, or initiation of a fraudulent chargeback;
  • Receipt of legal threats or claims arising from Client-submitted content.

Upon termination for any of the above reasons, no refund shall be issued. GCC Media Group may exercise all rights available under this Agreement, including the right to remove published articles and to pursue full legal remedies and damages.

13. Amendments to These Terms

GCC Media Group reserves the right to update, amend, or modify these Terms and Conditions at any time. Updated Terms will be published on gccmediagroup.com with a revised effective date. Continued use of our services following publication of updated Terms constitutes acceptance of those changes. Clients are encouraged to review these Terms periodically.

14. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with applicable laws. Any disputes arising out of or in connection with this Agreement shall be resolved in accordance with the laws of the State of Wyoming, without regards to its conflict of laws principles.

Prior to initiating legal proceedings, both parties agree to attempt in good faith to resolve any dispute through direct written communication, with a minimum notice period of fourteen (14) days. This obligation does not apply where GCC Media Group requires urgent injunctive or interim relief.

15. General Provisions

  • Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
  • Entire Agreement: This Agreement constitutes the entire agreement between the parties regarding its subject matter and supersedes all prior communications and understandings.
  • No Waiver: Failure to enforce any provision shall not constitute a waiver of the right to enforce it in future.
  • Assignment: The Client may not assign any rights or obligations under this Agreement without prior written consent of GCC Media Group.
  • Force Majeure: GCC Media Group shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including acts of God, government action, or third-party platform failures.
